A Strike Against Preemption

The U-S Supreme Court ruled on March 4, 2009, against the drug company Wyeth.

The decision essentially said federal agency regulations do not trump state law. The case involved a woman who sued over the warning label on a drug that was administered incorrectly. UT-Austin law professor Tom McGarity shares his insights about the political and philosophical underpinnings of the case. He is the author of The Preemption War: When Federal Bureaucracies Trump Local Juries.
